These Terms of Service ("Terms") are a legal agreement between you and Udabyte LLC (d/b/a Mindirus) ("Mindirus," "we," "us," or "our"). By accessing or using mindirus.com and related services (the "Service"), you agree to be bound by these Terms and our Privacy Policy at https://mindirus.com/privacy, which is incorporated by reference.
By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Mindirus is an AI-powered adaptive learning platform for certification exam preparation. The Service provides practice questions, study materials, AI-generated explanations, study plans, and progress tracking across multiple certification exams.
We reserve the right to modify, update, or discontinue any part of the Service at any time, including adding or removing exam courses, changing features, updating AI models, or adjusting content. We will make reasonable efforts to notify you of material changes that affect your paid subscription. If we discontinue an exam course that you have an active subscription for, we will provide a pro-rated refund or credit toward another course at your option. Routine updates, bug fixes, and content additions do not require advance notice.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You must be at least 16 years old to create an account. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. Mindirus is a direct-to-consumer platform and is not an educational institution; FERPA does not apply to data collected through this Service.
You may create only one account per person. Creating multiple accounts to circumvent trial limitations, exploit promotional offers, or evade account restrictions is prohibited and may result in termination of all associated accounts without refund. Accounts that remain inactive for more than 12 consecutive months may be flagged for deletion. We will send a notification email at least 30 days before deleting an inactive account, giving you the opportunity to retain your account by logging in.
By creating an account, you consent to receive electronic communications from Mindirus, including account notifications, billing receipts, subscription renewal reminders, Terms of Service updates, privacy policy changes, security alerts, and weekly study digests. These electronic communications satisfy any legal requirement that such communications be in writing. You may withdraw consent for non-essential communications by unsubscribing, but transactional and legal notices will continue to be delivered electronically as long as you maintain an account.
Free Trial: New users receive a 7-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial period, your access will be limited to free-tier features unless you subscribe to a paid plan.
Subscriptions and Auto-Renewal: When you subscribe to a paid plan, you authorize us to charge your payment method on a recurring basis at the then-current rate for your selected plan. Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. We will send you a reminder email at least 7 days before your trial converts to a paid subscription and before each annual renewal.
Pricing: Current pricing is displayed on our pricing page. We may change pricing with at least 30 days' advance notice. Price changes will take effect at the start of your next billing period after the notice.
Cancellation: You may cancel your subscription at any time through your account settings (Profile → Subscription → Cancel). Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for. Cancelling is as simple as subscribing — no phone calls, chat sessions, or additional steps required.
California Auto-Renewal Compliance: California residents: We will send you a renewal reminder email 15-45 days before each annual subscription renewal, including: the product name, the renewal price, the renewal date, and instructions for canceling. You may cancel at any time through your account settings with a clearly labeled cancellation button.
All payments are processed securely through Stripe. We do not store or have access to your payment card details. By subscribing, you authorize us to charge your payment method at the applicable rate. Prices are listed in USD and may be subject to change with notice.
Monthly subscriptions: Monthly subscription charges are non-refundable. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of your current billing period and you will retain full access until that date. No partial refunds are issued for unused portions of a monthly billing period.
Annual subscriptions: You may request a full refund within 7 days of your initial annual subscription purchase by contacting support@mindirus.com. After 7 days, annual charges are non-refundable. You may cancel at any time; cancellation takes effect at the end of your current annual billing period.
Substantial use: Refund requests may be denied if your account shows substantial use of the Service (e.g., completing a significant number of practice questions or accessing study materials extensively) during the refund-eligible period.
Processing: Approved refunds are processed to your original payment method within 5-10 business days via Stripe. Free trial periods are not eligible for refunds as no charge occurs during the trial.
Exceptions: No refund will be issued if your account is terminated by Mindirus for violation of these Terms. Refund eligibility begins on the date of purchase, not the date of first access.
Chargebacks: If you initiate a payment dispute (chargeback) with your bank or credit card company instead of contacting us first, we reserve the right to contest the dispute and provide evidence of account usage. We encourage you to contact support@mindirus.com to resolve any billing concerns before filing a dispute.

From time to time, Mindirus may offer promotional pricing, discount codes, referral credits, or other special offers. Unless otherwise stated: (a) promotional offers are non-transferable and cannot be combined with other offers; (b) promotional pricing applies only for the specified period, after which standard pricing resumes; (c) credits have no cash value and expire 12 months from issuance; (d) we reserve the right to modify or discontinue any promotion at any time. Abuse of promotional offers, including creating multiple accounts to redeem offers, may result in account termination.

If you provide feedback, suggestions, ideas, or recommendations about the Service ("Feedback"), you grant Mindirus a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, modify, and incorporate that Feedback into the Service or any other product without obligation or compensation to you. You waive any rights you may have in such Feedback, including moral rights. This applies to feedback submitted through the in-app feedback widget, email, or any other channel.
You retain ownership of content you create or submit through the Service, including study notes, quiz responses, and feedback text ("User Content"). By submitting User Content, you grant Mindirus a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze your User Content for the purpose of providing and improving the Service, including training and improving our adaptive learning algorithms. We will not publicly display your User Content or share it with third parties except as described in our Privacy Policy. You represent that you have the right to submit any User Content and that it does not infringe any third-party rights or contain actual exam questions from any certification body.
You agree to use the Service honestly and ethically. You shall not:
Mindirus is committed to supporting legitimate exam preparation. We reserve the right to remove content and terminate accounts that violate academic integrity standards.
All content on the platform, including questions, explanations, study materials, and software, is the property of Udabyte LLC (d/b/a Mindirus) or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial educational purposes only.
The Service uses artificial intelligence to generate practice questions, explanations, study recommendations, and coaching responses. AI-generated content may contain errors, inaccuracies, or outdated information. You should not rely solely on AI-generated content for exam preparation.
AI is also used in the following ways:
AI-generated content is not reviewed by certified exam instructors unless explicitly stated. We make no guarantee that AI-generated questions will appear on any actual certification exam. The Service is an independent study tool, not an official exam preparation product.
Mindirus is a study aid and does not guarantee that you will pass any certification exam. Exam outcomes depend on many factors beyond our control, including your prior knowledge, study habits, exam conditions, and the specific content of each exam administration. Our practice questions are independently created and may not reflect the exact content, format, or difficulty of actual certification exams. You acknowledge that the Service is a supplementary study resource and should not be your sole method of exam preparation. Under no circumstances shall Mindirus be liable for any exam failure or unsatisfactory exam score.
Mindirus is not affiliated with, endorsed by, or sponsored by any certification body or exam provider, including but not limited to ISC2 (CISSP), Cisco (CCNA), CompTIA (Security+), Amazon Web Services (AWS), Microsoft (Azure), PMI (PMP), Kubernetes (CKA), NCSBN (NCLEX), NBME (USMLE), AAMC (MCAT), ETS (GRE), GMAC (GMAT), College Board (SAT, AP), ACT Inc. (ACT), or any state licensing board (CBEST). All certification names, logos, and trademarks are the property of their respective owners. Use of these names is for identification purposes only and does not imply endorsement.
The Service integrates with third-party services including Stripe (payments), Google (authentication), Cloudflare (security and DNS), Sentry (error monitoring), and Plausible (analytics). Your use of these third-party services is governed by their respective terms and privacy policies. Mindirus is not responsible for the availability, accuracy, or practices of any third-party service. If a third-party service experiences downtime or changes its terms, we are not liable for any resulting disruption to the Service.
If you believe that content on the Service infringes your copyright, please send a notice to our designated DMCA agent at support@mindirus.com with the following information: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. We do not guarantee any particular exam outcome or score.
To the maximum extent permitted by law, Udabyte LLC (d/b/a Mindirus) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, exam failure, or inability to access the Service.
To the maximum extent permitted by law, in no event shall Mindirus's total aggregate liability to you for all claims arising out of or related to the Service exceed the total amount paid by you to Mindirus during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Udabyte LLC (d/b/a Mindirus), its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through the Service.
We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.
Upon termination of your account: (a) your right to access the Service ceases immediately; (b) we will delete your personal data in accordance with our Privacy Policy within 30 days; (c) you may request a copy of your data before deletion by contacting support@mindirus.com. Prepaid subscription fees for the remaining unused portion of your billing period will be handled according to our Refund Policy.
The following sections survive termination: Intellectual Property, AI-Generated Content, Trademarks and Non-Affiliation, Feedback and Suggestions, User Content, Indemnification, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution, Governing Law, and General Provisions.
Informal Resolution: Before filing any formal proceeding, you agree to first contact us at support@mindirus.com to attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.
Binding Arbitration: If we cannot resolve the dispute informally, you and Mindirus agree to resolve any disputes through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English. The arbitrator's decision will be final and binding.
Class Action Waiver: You and Mindirus agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding. If this waiver is found unenforceable, the entire arbitration provision shall be void.
Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized access to the Service.
Opt-Out: You may opt out of this arbitration provision by sending written notice to support@mindirus.com within 30 days of creating your account. The notice must include your name, email, and a clear statement that you wish to opt out of arbitration.
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Georgia, and you consent to the personal jurisdiction of such courts.
We may update these Terms from time to time. We will provide at least 30 days' advance notice of material changes via email to the address associated with your account and/or by posting a prominent notice on the Service. If you disagree with the changes, you may cancel your subscription before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Mindirus regarding the Service and supersede all prior agreements.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Mindirus may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Force Majeure: Mindirus shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, cyberattacks, third-party service outages, or government actions.
Accessibility: Mindirus is committed to making the Service accessible to all users. If you experience accessibility barriers, please contact support@mindirus.com and we will work to address your concerns.
Google Authentication: If you sign in using Google, your use of Google authentication is subject to Google's Terms of Service. We receive only your name, email, and profile picture from Google.
Export Compliance: The Service is operated from the United States. You represent that you are not located in, or a resident of, any country subject to U.S. trade sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions), and that you are not on any U.S. government restricted party list. You agree to comply with all applicable export control and sanctions laws.
Records Retention: We retain records of your consent to these Terms, auto-renewal authorizations, and privacy preferences for a minimum of 3 years as required by applicable state consumer protection laws.
